1. Acceptance of Terms

By using www.elevateyourwellness.co.za ("Site"), you agree to these T&Cs. If disagreeing, refrain from using the Site.

2. Definitions

  • "We/Us": Elevate Wellness (Pty) Ltd
  • "Products": Supplements, nutrition, skincare sold on Site
  • "CPA": Consumer Protection Act (Act 68 of 2008)

3. Product Information & Disclaimers

  • Wellness Products Only:
    • Products are dietary supplements/nutritionals – not medicines or medical treatments.
  • No Guaranteed Outcomes:
    • Individual results vary based on diet, lifestyle, and biology.
  • Consultation Required:
    • Consult a healthcare provider before use if:
    • Pregnant/nursing
    • Under 18
    • On medication/have medical conditions
  • Accurate Representation:
    • Product images/descriptions aim for accuracy but may vary slightly.

4. Orders & Payment

  • Order Acceptance:
    • Confirmation email ≠ order acceptance. We reserve right to cancel orders (e.g., pricing errors, stock shortages).
  • Payment Methods:
    • EFT, credit/debit cards (Visa/Mastercard), SnapScan.
  • VAT Included:
    • All prices include 15% VAT.
  • Fraud Checks:
    • We may request ID/address verification for high-risk orders.

  • 14-Day Cooling-Off Period:
    • Unopened products may be returned (exclusions apply).

7. User Conduct & Restrictions

Prohibited:

  • Reselling products commercially without authorization.
  • Automated scraping/copying of Site content.
  • Uploading malware or disrupting Site operations.

8. Intellectual Property

  • Ownership:
    • All Site content (logos, text, images) is our property.
  • Limited License:
    • You may view/download content for personal use only.

9. Limitation of Liability (CPA 61)

We are not liable for:

  • Indirect/consequential damages.
  • Product misuse or failure to follow instructions.
  • Delivery delays/losses.
    • Maximum liability capped at order value.

10. Dispute Resolution

  2. Mediation: If unresolved, parties will mediate via SAACR.

11. Governing Law

These T&Cs are governed by SA law. Disputes subject to Gauteng High Court jurisdiction.

12. Amendments

We may update T&Cs. Continued Site use = acceptance. Check "Last Updated" date.

"Elevate Calm+Restore," "Ultra Boost," and all herbal/products:

  • Not evaluated by SAHPRA: These supplements are not medicines.
  • General Wellness Support Only: No claims to diagnose, treat, or cure diseases.
  • Stimulant Warning: Products with caffeine (e.g., Burn+Energy) – avoid if sensitive.
